Geschäftsordnung Mozart-Gemeinden

§ 1 Präambel

Die Internationale Stiftung Mozarteum (im Folgenden „ISM“) pflegt das Erbe von Wolfgang Amadé Mozart und hat das Ziel, das Wissen über seine Persönlichkeit und sein Schaffen auf einer breiten und wissenschaftlich fundierten Basis möglichst vielen Menschen in der Welt zugänglich zu machen.

§ 2 Mozart-Gemeinden

In diesem Sinne befürwortet und befördert die ISM die Aktivitäten von Mozart-Gemeinden und -Gesellschaften (im Folgenden „Mozart-Gemeinden“), die sich entsprechend dem Vereinszweck der ISM (Satzungen der ISM, § 2) betätigen. Die ISM versteht sich als Dachverband der in aller Welt jeweils für sich eigenständig operierenden Mozart-Gemeinden, die als Außerordentliche

Mitglieder in die ISM aufgenommen werden können.

§ 3 Aufnahme in die ISM

Die Aufnahme in die ISM als Außerordentliches Mitglied kann von einer Mozart-Gemeinde bei Erfüllung folgender Kriterien gemäß § 3 der Satzungen der ISM beantragt werden:

Die Mozart-Gemeinde ist als Verein gemäß den rechtlichen Rahmenbedingungen des Staates, in dem sie ihren Sitz hat, organisiert.
Die Mozart-Gemeinde erfüllt, soweit aus der jeweiligen nationalen Sicht anwendbar, den Status der Gemeinnützigkeit.
Aus den Statuten der jeweiligen Mozart-Gemeinde wird die Betätigung im Sinne des Zwecks und der Ziele der ISM deutlich.
Ansprechpartner, in der Regel Name und Adresse derVorstandsmitglieder und etwaiger Sekretariate, werden bei der ISM hinterlegt und auf dem aktuellem Stand gehalten. Entsprechende Nachweise, in der Regel in deutscher oder englischer Sprache, müssen mit dem Antrag der ISM vorgelegt werden. Über die beauftragte Aufnahme aus Außerordentliches Mitglied in die ISM entscheidet das Kuratorium.

§ 4 Mitgliedschaft

Die vom Kuratorium der ISM genehmigte Mitgliedschaft einer Mozart- Gemeinde gilt für die Dauer von zehn Jahren. Eine gewünschte Verlängerung der Mitgliedschaft ist zeitgerecht vor Ablauf dieser zehn Jahre bei der ISM unter Beifügung der Nachweise gemäß § 3 dieser Geschäftsordnung zu beantragen.

Bei schwerwiegenden Verstößen einer Mozart-Gemeinde gegen die Kriterien gemäß § 3 dieser Geschäftsordnung kann das Kuratorium der ISM die Mitgliedschaft einer Mozart-Gemeinde wieder aberkennen.

§ 5 Rechte und Pflichten

Die Mozart-Gemeinde ist berechtigt, sich nach außen als eine von der „Stiftung Mozarteum Salzburg anerkannte Mozart-Gemeinde“ zu präsentieren und das von dieser bereitgestellte Logo der Mozart-Gemeinden einzusetzen.

Die Mozart-Gemeinde verpflichtet sich, keine Aktivitäten zu unternehmen, die den berechtigten Interessen der ISM entgegenstehen oder deren Ansehen schädigen.

Der jährliche Mitgliedsbeitrag entspricht dem eines Ordentlichen Mitglieds und ist nach Vorschreibung der ISM an diese zu entrichten.

§ 6 Stimmrecht

Das Wahl- und Stimmrecht des Außerordentlichen Mitglieds übt der Vorsitzende der jeweiligen Mozart-Gemeinde einfach aus; er kann einen

Stellvertreter, der nachweislich Mitglied der Mozart-Gemeinde ist, als seinen Vertreter bevollmächtigen. Die Rechte von Mitgliedern einer Mozart-

Gemeinde, die zusätzlich ad personam Ordentliche Mitglieder oder Außerordentliche Mitglieder der ISM sind, bleiben hiervon unberührt.

§ 7 Leistungen der ISM

Die ISM fördert die Vernetzung der Mozart-Gemeinden durch folgende Aktivitäten:

regelmäßige Informationen über die Aktivitäten der ISM durch einen elektronischen Newsletter
Einberufung eines Treffens der Mozart-Gemeinden, in der Regel in Verbindung mit der alljährlichen Mozartwoche
Bereitstellung und Pflege eines gemeinsamen Internetauftritts auf der Website der ISM
Im Rahmen ihrer Möglichkeiten berät die ISM die Mozart-Gemeinden und zeigt Präsenz bei deren Aktivitäten.
Die ISM räumt den Mozart-Gemeinden im Rahmen der Verfügbarkeit von Kartenkontingenten einen Rabatt auf Eigenveranstaltungen der

ISM in Höhe von 10 Prozent ein, soweit die Bestellung in Gruppenstärke und im Namen und auf Rechnung der Mozart- Gemeinde erfolgt.

Hingewiesen wird weiters ausdrücklich auf die Satzungen der ISM, § 4 („Rechte und Pflichten der Mitglieder“).

§ 8 Treffen der Mozart-Gemeinden

Das Treffen der Mozart-Gemeinden dient dem Meinungsaustausch zwischen der ISM und den Mozart-Gemeinden, vertreten durch deren Vorsitzende. Die Einladung zum Treffen der Mozart-Gemeinden wird durch die ISM schriftlich vorgenommen; die Einladung kann auch auf elektronischem Weg (E-Mail) erfolgen.

Beim Treffen, das vom Präsidenten der ISM oder durch einen von diesem benannten Vertreter durchgeführt wird, werden die Mozart-Gemeinden über aktuelle Entwicklungen der ISM informiert; die Mozart-Gemeinden haben die Möglichkeit, ihre Aktivitäten kurz vorzustellen. In der Regel wird dabei mindestens einer Mozart-Gemeinde die Möglichkeit eingeräumt, sich ausführlicher zu präsentieren. Über das Treffen wird seitens der ISM ein Protokoll angefertigt, das in der Regel binnen vier Wochen versandt wird.

Procedural Rules of the Mozart Communities

§ 1 Preamble

The International Mozarteum Foundation (Internationale Stiftung Mozarteum, referred to in the following as ‘ISM’) fosters the heritage of Wolfgang Amadé Mozart and aims to make knowledge about his personality and oeuvre accessible to as many people as possible throughout the world on a broad and academically well founded basis.

§ 2 Mozart Communities

Bearing this in mind, the ISM advocates and promotes the activities of the Mozart Communities and Mozart Societies (in the following referred to as

‘Mozart Communities’) which are active in accordance with the purpose of the association ISM (ISM statutes § 2). The ISM sees itself as the umbrella organization of the Mozart Communities which operate on an individual and independent basis throughout the world and which can be accepted as associate members of the ISM.

§ 3 Acceptance in the ISM

A Mozart Community can apply for acceptance as an associate member of the

ISM if the following criteria according to § 3 of the ISM statutes are fulfilled:

The Mozart Community is organized as an association according to the

legal circumstances of the state in which it has its headquarters.

In so far as applicable according to the relevant national situation, the

Mozart Community fulfills the status of a non-profit-making

organization.

From the statutes of the relevant Mozart Community its activity is

clarified in the sense of the purpose and aims of the ISM.

Contact persons, usually the names and addresses of the board

members and where applicable secretariats, are to be made known to the ISM and kept up to date.

Relevant documentary evidence, usually in German or English, has to be submitted with the application to be accepted by the ISM. The board of trustees decides on whether the application to be accepted as an associate member in the ISM is granted.

§ 4 Membership

When membership of a Mozart Community in the ISM has been approved by the board of trustees of the ISM, it is valid for a period of ten years. If an

extension of membership is desired, an application must be made in good time before the end of this ten-year term to the ISM by submitting the documentary evidence according to § 3 of these procedural rules in the case of severe violations by a Mozart Community against the criteria according to § 3 of these procedural rules, the board of trustees of the ISM can revoke the membership of a Mozart Community.

§ 5 Rights and Obligations

The Mozart Community is entitled to present itself in public as a ‘Mozart Community recognized by the Mozarteum Foundation Salzburg’ and to use the

logo of the Mozart Community as provided. The Mozart Community is obliged not to undertake any activities which contravene the justified rights of the ISM or damage its image. The annual membership fee corresponds to that of a regular member and is to be paid to the ISM upon payment request.

§ 6 Active and Passive Right of Vote

The chairperson of the relevant Mozart Community exerts the associate member’s right to place one vote; he or she can authorize a deputy who is a proven member of the Mozart Community as his or her representative. The rights of members of a Mozart Community who are additionally ad personam regular members or associate members of the ISM remain unaffected by this.

§ 7 Services provided by the ISM

The ISM promotes networking between the Mozart Communities through the following activities:

Regular information about the ISM’s activities by means of electronic newsletter.
-Summoning of a meeting of the Mozart Communities, usually in association with the annual Mozart Week.
The provision and maintenance of a joint internet presence on the ISM’s website.
As far as possible the ISM offers advice to the Mozart Communities and aims to ensure that it is represented in their activities.
The ISM offers Mozart Communities a 10% discount on tickets, depending on availability, for performances organized by the ISM.

This applies if the order is made as a group, in the name of the Mozart

Community and at its own expense. It is explicitly requested to take note § 4 of the ISM statutes (‘Rights and

Obligations of Members’).

§ 8 Meetings of the Mozart Communities

Meetings of the Mozart Communities aim to promote the communication between the ISM and the Mozart Communities, represented by their

chairpersons. The ISM sends out invitations to meetings of the Mozart Communities in writing; the invitation can also be made electronically via email.

At the meeting, which is chaired by the president of the ISM or by a representative named by him, the Mozart Communities are informed about current developments of the ISM; the Mozart Communities have the chance to present a brief outline of their activities. On such occasions at least one of the Mozart Communities is given the chance to make a more detailed presentation of its activities. Minutes to the meeting will be provided by the ISM usually within four weeks.

These Procedural Rules of the Mozart Communities have been adopted by the board of trustees of the Internationale Stiftung Mozarteum on 6 June 2016 and enter into force immediately.
